Terms and Conditions of Location Service

Purpose of Article 1

These terms and conditions are aimed at regulating the rights, obligations, responsibilities, and other necessary matters between the company and the personal location information subject (hereinafter referred to as "user") using location-based services provided by Trading Co., Ltd. ("Company").

The validity and modification of the terms and conditions of Article 2

  1. These terms and conditions take effect when the user agrees to these terms and conditions and is registered as a user of the location-based service according to the procedures set by the company.

  2. The company may amend the terms and conditions for the purpose of reflecting changes in laws or location-based services.

  3. If the terms and conditions are changed, the company will post the changes at least 7 days in advance through the company's website and other notice pages.

  4. However, if the revised content changes significantly, we will post it 30 days in advance.

 

Rules outside the terms and conditions

Matters not specified in these terms and conditions shall be governed by relevant laws, such as the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Telecommunications Business Act, and the Act on Promotion and Protection of Information and Communication Network.

 

Contents of Article 4 Service

The company provides the following location-based services using the user's current location or area containing the current location of the user collected directly or from the location information service provider.

  1. Checking the commuting range based on the user's location information.

  2. Location-based customized advertisement.

 

Article 5 Service Charges

The location-based service provided by the company is free. However, the data communication fee incurred when using wireless services is separate, and it follows the policies of each mobile carrier that users subscribe to.

 

Restriction or suspension of service use

  1. The company may restrict, change, or suspend all or part of the location-based service if it is unable to maintain the location-based service due to various circumstances or legal reasons, such as policy changes of the location-based service provider.

  2. However, in the case of suspension of location-based services under the above paragraph, the company will notify the user in advance through the company's website and other notice pages.

 

The rights of the subject of personal location information

  1. Users can withhold all or part of their consent to collect, use, and provide personal location information at any time.

  2. Users can withdraw all or part of their consent to collect, use, and provide personal location information at any time. In this case, the company will destroy the data confirming the collection, use, and provision of the withdrawn range of personal location information and location information without delay.

  3. Users may request a temporary suspension of the collection, use, and provision of personal location information, and in this case, the company cannot refuse it and prepares technical means to meet it.

  4. Users may request the company to view or notify the data below, and if there is an error in the data, they may request correction. In this case, we do not reject the request without justifiable reasons.

  5. Data confirming the fact that location information is collected, used, and provided to users.

  6. Reasons and contents of the user's personal location information provided to a third party pursuant to the provisions of the Act on the Protection, Use, etc. of Location Information or other statutes.

  7. Users can request the company using the contact information under Article 15 of this Terms and Conditions for the exercise of their rights.

 

Use or provide personal location information

  1. When the company provides location-based services using personal location information, it notifies and obtains consent to these terms and conditions.

  2. The company does not provide personal location information to a third party without the consent of the user, and when providing it to a third party, it notifies the recipient and the purpose of the provision in advance and obtains consent.

  3. The company automatically records and preserves data confirming the collection, use, and provision of personal location information in accordance with Article 16 (2) of the Act on the Protection and Use of Location Information, and keeps the data for six months.

 

The rights of legal representatives

For users under the age of 14, the company must obtain consent from users and their legal representatives to provide location-based services using personal location information and to provide personal location information to third parties. In this case, the legal representative has all the rights of the user pursuant to Article 7 of this Terms and Conditions.

 

Article 10 The rights of persons obligated to protect child consent under the age of 8

  1. If a person (hereinafter referred to as a "guardian") who falls under Article 26(2) of the Act on the Protection and Use of Location Information of a person (hereinafter referred to as "children under 8") agrees to use or provide personal location information for life or body protection of children under 8 years of age, etc.,

  2. Children under the age of 8

  3. Guardians under age.

  4. A person with a mental disability pursuant to Article 2 (2) 2 of the Welfare of Persons with Disabilities Act and falls under Article 2 (2) of the Employment Promotion and Vocational Rehabilitation Act (only those with disabilities registered under Article 32 of the Welfare of Persons with Disabilities Act).

  5. A person liable for protection who intends to agree to the use or provision of personal location information for the protection of life or body of children under the age of 8 shall submit a written consent form to the company with a document proving that he/she is obligated to protect.

  6. If the person obligated to protect agrees to use or provide personal location information for children under the age of 8, etc., the user shall have all rights under Article 7 of this Agreement.

 

Designation of the person in charge of location information management

  1. The company designates and operates a person in a position to take practical responsibility to properly manage and protect location information and to smoothly handle complaints from personal location information subjects.

  2. The person in charge of location information management is the head of the department that provides location-based services, and details are subject to the supplementary provisions of this Agreement.

 

Article 12 Compensation for Damages

In the event of damage caused by violating the provisions of Articles 15 and 26 of the Act on the Protection and Use of Company Location Information, the user may claim damages from the company. The company cannot escape responsibility if it fails to prove that there is no intention or negligence.

 

Article 13 Indemnity

  1. If the company is unable to provide location-based services in any of the following cases, it shall not be liable for damages incurred to the user.

  2. In a case where there is a state of natural disasters or force maje majeure equivalent thereto.

  3. Where there is an intentional obstruction of service by a third party who has entered into a service partnership contract with the company to provide location-based services.

  4. In the case where there is an obstacle to the use of location-based services due to reasons attributable to the user,

  5. In the case where there is no intentional or negligence of other companies except for subparagraphs 1 to 3,

  6. The company does not guarantee information, data, reliability, and accuracy of facts posted on location-based services and location-based services, and is not liable for any damages to users caused by them.

 

Article 14 Mediation of Disputes and Others

  1. The company faithfully consults with users to resolve disputes related to location information.

  2. If the dispute is not resolved in the consultation under the preceding paragraph, the company and users may apply for finance to the Korea Communications Commission pursuant to Article 28 of the Act on the Protection and Use of Location Information, or to the Personal Information Dispute Mediation Commission.
